A Harrow man has been banned from keeping dogs for seven years after admitting to using harsh disciplinary methods on his pet, a Great Dane cross.
Daniel Kirwan, of Rosslyn Crescent in Harrow, pleaded guilty to one offence under the Animal Welfare Act 2006. He was sentenced at Willesden Magistrates’ Court on 20 December.
In addition to the ban, he was placed under a 12-month community order, including 15 hours of rehabilitation activities and drug rehabilitation. He was also ordered to pay £100 in court costs and a £114 victim surcharge.
The RSPCA investigated claims that Kirwan mistreated his dog, Lizzie, following reports from a member of the public who submitted six video and audio clips. The clips captured high-pitched yelps and shouting, which an RSPCA animal behaviourist said were indicative of fear and distress.
“I could hear high-pitched yelps with long pauses between them, which in my opinion conveyed distress,” the behaviourist said.
“These behaviours were likely to have been perceived as threatening by Lizzie and caused ongoing distress.”
RSPCA Animal Rescue Officer Holly Walker attended Kirwan’s flat with police on 7 March last year, where Lizzie was seized and taken for examination at the RSPCA Finsbury Park Animal Hospital. Officer Walker noted that Lizzie appeared “unsure, submissive and anxious,” both at home and in other environments.
The court heard that Kirwan had mental health and drug addiction issues. Lizzie was cared for by the RSPCA after being removed from his care.
Speaking after the case, RSPCA Inspector Nicole Broster said, “Lizzie was a very fearful dog when she came into the care of the RSPCA because of the harsh treatment she was subjected to by her former owner. Listening to the audio clips was deeply upsetting due to the obvious fear and distress Lizzie was exhibiting.”
The RSPCA thanked the public for reporting concerns about animal cruelty, which enabled them to investigate and secure a conviction.
The ban prevents Kirwan from owning dogs until 2031.
